1. Who Is Responsible for Your Data?

"MyCVPlanner", "we", "us" and "our" refer to Robert Kalb in this Privacy Policy. MyCVPlanner is the name of the software product and does not, by itself, identify a separate legal entity.

2. Scope

This Privacy Policy applies to personal data processed in connection with:

  • the MyCVPlanner downloadable software ("Software");
  • the website at https://mycvplanner.com;
  • purchases, licence activation and entitlement management;
  • software updates, diagnostics and optional usage analytics; and
  • customer support and other communications.

A payment or Merchant of Record provider may be the legal seller for a transaction and will process payment data under its own privacy policy.

3. Personal Data We Process

3.1 Purchase and licence data

When you buy or activate MyCVPlanner, we may receive or process:

  • your name and email address;
  • billing country and, where needed, business or tax status;
  • order, transaction and refund identifiers;
  • licence key, entitlement, activation and device-association information; and
  • communications relating to the purchase.

We do not receive complete payment-card details when payments are processed by a third-party payment or Merchant of Record provider.

3.2 CV and document content

OPTION A — LOCAL PROCESSING ONLY: The CVs, profile information, photographs and other document content you enter into MyCVPlanner are stored and processed locally on your device. We do not receive that content unless you deliberately send it to us, for example in a support request.

OPTION B — LOCAL PROCESSING WITH OPTIONAL ONLINE FEATURES: The CVs, profile information, photographs and other document content you enter into MyCVPlanner are ordinarily stored and processed locally on your device. When you deliberately use an online feature, the data identified in that feature may be transmitted to the service providers listed in Section 6 for the purpose explained before transmission.

OPTION C — CLOUD OR AI PROCESSING: MyCVPlanner transmits the following CV or document content to the following service for the following purpose: [TO COMPLETE: exact data, provider, country, purpose, whether content is retained or used for model training, and retention period].

CVs commonly contain sensitive and highly personal information. Do not include information that is unnecessary for your intended CV, and do not enter another person's information unless you have a lawful basis and authority to do so.

3.3 Support and communications

If you contact us, we process your contact details, message, attachments and any technical or CV information you choose to provide. You should remove unnecessary personal data from screenshots, logs and example CVs before sending them.

3.4 Technical, update and diagnostic data

Depending on the Software configuration, we may process:

  • Software version and update status;
  • operating system, device type, language and technical configuration;
  • IP address and approximate country derived from it;
  • licence-validation and activation events;
  • crash reports, error details and performance information; and
  • feature-use statistics.

3.5 Access credentials stored in settings

If you choose to save third-party access credentials (for example, LinkedIn username and password) in Software settings, they are stored locally in encrypted form and are decrypted only for use inside the Software. If you run automation scripts that support session reuse, the Software may also store third-party website session data (for example login cookies) in a local user folder on your device so the script can reuse an existing login.

3.6 Website data and cookies

When you visit our website, the hosting provider may process IP address, access time, requested page, referrer, browser and device information in server logs.

4. Why We Process Personal Data

We process personal data as necessary to:

  • deliver the Software, licence and purchased functionality;
  • validate licences, prevent misuse and maintain security;
  • process purchases, refunds and accounting records;
  • provide requested support and respond to communications;
  • deliver optional online features selected by the user;
  • diagnose errors and improve reliability where permitted;
  • comply with legal obligations and establish or defend legal claims; and
  • inform users about material operational, legal or privacy changes.

Where the EU or UK GDPR applies, the corresponding legal bases are performance of a contract, compliance with legal obligations, our legitimate interests in operating and securing MyCVPlanner, and consent where required. You may withdraw consent at any time without affecting processing that occurred before withdrawal.

5. Sources of Personal Data

We receive personal data:

  • directly from you;
  • automatically from the Software or website as described above;
  • from the payment or Merchant of Record provider handling your order; and
  • from a business customer that buys or administers a licence for you.

6. Service Providers and Other Recipients

We disclose only the data reasonably necessary for the relevant purpose.

A recipient taking over the product or contractual relationships must process personal data consistently with applicable law and the information provided to affected users.

7. International Data Transfers

Some providers may process data outside Switzerland or your country. Where the destination does not provide legally recognised adequate protection, we use an applicable safeguard, such as approved standard contractual clauses, or rely on another lawful transfer mechanism. Where required by Swiss law, we inform you of the destination country and applicable safeguard.

8. Retention

We retain personal data only for as long as needed for the relevant purpose:

  • purchase, licence and accounting records: for the statutory retention period,

    • generally ten years for Swiss accounting records;

  • licence-entitlement data: for the duration of the licence and any period

    • reasonably needed to handle disputes or prevent abuse;

Data may be retained longer where required by law, a legal hold or an ongoing claim. It is then deleted or anonymised when the retention purpose ends.

9. Your Choices

Depending on the features used, you may:

  • disable optional telemetry in the Software settings;
  • manage non-essential website cookies;
  • avoid online features and process documents locally, if supported;
  • delete locally stored CV content using the Software or your operating system;

    • and

  • unsubscribe from optional marketing communications.

Removing the Software does not automatically delete purchase, licence, support or legally required accounting records held by us or by the payment provider.

10. Your Data-Protection Rights

Subject to applicable law, you may request:

  • access to your personal data;
  • correction of inaccurate data;
  • deletion of data;
  • restriction of processing;
  • a portable copy of data you provided;
  • withdrawal of consent;
  • objection to processing based on legitimate interests; and
  • information about international transfers.

You may also complain to the Swiss Federal Data Protection and Information Commissioner (FDPIC) or, where applicable, your local data-protection authority. To exercise a right, email support@mycvplanner.com. We may need to verify your identity before acting.

11. Security and User Backups

We use reasonable technical and organisational measures appropriate to the nature of the data. No system can be guaranteed completely secure.

You are responsible for securing your device, access credentials, exported documents and backups. Because development, online features or the MyCVPlanner project may be discontinued, you should regularly export and independently back up any content you need to retain.

12. Children

MyCVPlanner is not directed specifically at children. A minor should use the Software only with any consent or supervision required by the law applicable to that minor.

13. Discontinuation of MyCVPlanner or the Business

We may discontinue the Software, website, online features, support, or the MyCVPlanner project. If the business ceases, we will delete or anonymise personal data that is no longer required, subject to legal retention duties and the establishment or defence of legal claims. Where a lawful successor takes over relevant operations or contracts, personal data may be transferred to that successor with appropriate notice where required.

14. Changes to This Privacy Policy

We may update this Privacy Policy to reflect changes in the Software, providers or law. The current version will be published with a revised "Last updated" date.

If a change is material and we have a current email address for you, we will send notice to that address before the change takes effect and may also display a notice in the Software. Except where a shorter period is reasonably necessary for an urgent legal or security reason, we will aim to provide at least 30 days' notice. You are responsible for providing a current, reachable email address.

A Privacy Policy update does not by itself establish consent or override your data-protection rights. Where the law requires consent for new processing, we will request it separately. Acceptance of revised contractual terms governing continued use of the Software is addressed in the EULA and Terms of Sale.

1. Seller and Scope

These Terms of Sale apply to orders for the downloadable MyCVPlanner software. The software licensor and product operator is:

MyCVPlanner is a product name and does not, by itself, identify a separate legal entity.

The checkout may identify a third-party Merchant of Record as the legal seller of the transaction. In that case, the Merchant of Record's terms govern payment, tax, invoicing, withdrawal and refund administration. The MyCVPlanner EULA governs your right to install and use the Software. If there is a conflict, each document governs its stated subject matter, subject always to mandatory law.

2. Product

MyCVPlanner is downloadable software for creating and managing CV-related content and documents. The exact included features, supported operating systems, licence type and device allowance are those shown on the product and checkout pages when you order.

MyCVPlanner does not guarantee employment, interviews, acceptance by an applicant-tracking system or any other career outcome.

3. Ordering and Contract Formation

Before ordering, you will be shown the main product characteristics, system requirements, total price, applicable taxes, licence scope and payment method. You can correct input errors before submitting the order.

An order is completed when the legal seller accepts payment and sends an order confirmation or provides download or licence access, whichever occurs first. The seller may reject or cancel an order for payment failure, suspected fraud, sanctions restrictions, pricing errors or legal reasons and will refund any amount collected where required.

You must provide accurate purchase and contact information and keep your order confirmation and licence details.

4. Prices, Taxes and Payment

Prices and currencies are displayed at checkout. The total price, including applicable VAT, GST, sales tax or similar transaction taxes, will be shown before payment where required.

Payment is processed using the methods shown at checkout. The payment or Merchant of Record provider processes financial data under its own terms and privacy policy.

5. Delivery

The Software is delivered electronically by download link, account access, licence key or another method stated at checkout. You are responsible for downloading and securely retaining the installer, order confirmation and licence information.

If delivery fails, contact support@mycvplanner.com and the seller identified on your receipt without undue delay.

6. Licence

Purchase provides a licence, not ownership of the Software. Installation and use are subject to the MyCVPlanner EULA.

Unless the checkout expressly says otherwise, the purchase provides a single-device Perpetual Licence for the Licensed Version. "Perpetual" means that the licence has no fixed contractual end date. It does not promise future versions, updates, compatibility, support, download availability, online services, continued business operations or continuation of the MyCVPlanner project.

7. System Requirements

You must review the disclosed operating-system, hardware and dependency requirements before ordering. Compatibility with systems, devices or third-party software that are not expressly listed is not promised.

8. Updates, Support and Discontinuation

Unless expressly included in the offer:

  • no maintenance plan or dedicated support is included;
  • no feature update, upgrade, compatibility update or new version is promised;
  • support, downloads, activation and online features may be changed or

    • discontinued; and

  • the MyCVPlanner project or the Licensor's business may be transferred,

    • suspended, abandoned or permanently closed.

A valid Perpetual Licence for an installed Licensed Version is not terminated solely because development or the business ends. Nevertheless, continued installation, activation, compatibility, security and usability are not guaranteed. You should retain the installer and licence information and regularly export and back up your content.

These terms do not exclude security updates, conformity obligations or remedies that mandatory law requires.

9. Consumer Withdrawal

The following applies only where the consumer's mandatory law provides a withdrawal right.

For digital content supplied immediately by download and not on a tangible medium, the consumer may be asked to:

  • expressly request immediate delivery during the withdrawal period;
  • expressly consent to performance beginning immediately; and
  • acknowledge that the statutory withdrawal right is lost when performance

    • begins, to the extent permitted by applicable law.

If the legally required consent, acknowledgement or confirmation is not obtained, the withdrawal right is not excluded merely by this document.

10. Refunds and Statutory Remedies

Except where the checkout or Merchant of Record offers an additional refund right, completed digital purchases are not voluntarily refundable after download, licence-key disclosure or activation.

This does not affect mandatory rights. If the Software is not supplied, is materially defective or is not in conformity under applicable mandatory law, you may be entitled to correction, replacement, a price reduction, termination or a refund. Contact support@mycvplanner.com and the seller shown on your receipt with the order number and a description of the issue.

Discontinuation of future development, optional support or non-promised updates does not itself create a refund right. However, this sentence does not remove a mandatory remedy where discontinuation causes a legally relevant failure to supply or lack of conformity.

11. Acceptable Use and Intellectual Property

You must comply with the EULA and must not share licence keys, circumvent technical controls, copy or redistribute the Software, change or create derivative works from it, decompile or disassemble it, reverse engineer it, or use it to infringe another person's rights. Only narrow exceptions that cannot legally be waived remain unaffected. Creating and editing your own CV content through the Software's intended functions is permitted.

12. Warranty and Liability

The warranty disclaimers and liability limitations in the EULA apply to the maximum extent permitted by law. Nothing in these Terms excludes intentional misconduct, gross negligence, fraudulent concealment, or a consumer right or other liability that cannot legally be excluded.

13. Privacy

Personal data is handled according to the MyCVPlanner Privacy Policy and the privacy policy of the payment or Merchant of Record provider.

14. Changes to Terms and Required Re-Acceptance

The Terms accepted at the time of purchase govern the completed transaction, including its price and delivery. We may amend these Terms and the EULA prospectively for valid reasons, including changes in law or regulatory requirements, security or fraud prevention, technical requirements, Software functionality, operational needs, the business model, or the clarification or correction of terms.

For a material change affecting an existing user, we will send notice to the latest email address provided for the licence and may also display a notice in the Software. Except where a shorter period is reasonably necessary for an urgent legal or security reason, notice will be sent at least 30 days before the change takes effect. You are responsible for providing a current, reachable email address.

Continued use after the effective date requires affirmative acceptance of the revised EULA and any revised terms governing continued use. If you decline or do not accept them, your licence and right to use the Software terminate on that date. The Software may then block launch, activation or continued use, and you must stop using and delete it. Refusal of revised terms does not by itself create a voluntary refund right.

No change retroactively alters the agreed price or completed delivery, removes accrued rights, or limits a non-waivable right. Where mandatory law gives you a right to continue using an earlier version, terminate without charge, receive a refund or obtain another remedy, that law prevails.

15. Governing Law and Jurisdiction

These Terms are governed by substantive Swiss law, excluding its conflict rules and the United Nations Convention on Contracts for the International Sale of Goods.

Subject to mandatory jurisdiction rules, the courts at the Licensor's domicile in the Canton of Zug, Switzerland, have jurisdiction. Consumers retain any mandatory protection and right to bring proceedings in another competent court provided by applicable law.

2. What Cookies Are

Cookies are small text files or identifiers stored by a website in the user's browser. Some cookies are required for website functions. Others, such as analytics cookies, are optional and help measure website use.

This Policy covers cookies on the MyCVPlanner website only. The downloadable desktop Software does not use browser cookies. The website uses cookies for account login and, after any required consent, Google Analytics 4. If you use Software automation scripts with session reuse, those scripts may store third-party website session cookies locally on your own device for that automation workflow.

3. Technically Necessary WordPress Cookies

The website currently uses the following first-party WordPress cookies:

  • `wordpress_logged_in_0c07924d99832b1cf9a59fa564c9fb32` maintains the

    • authenticated website session and permits the user to remain logged in when returning later;

  • `wordpress_sec_0c07924d99832b1cf9a59fa564c9fb32` supports authentication and

    • security for protected WordPress areas; two instances were observed in the supplied browser inspection;

  • `wordpress_test_cookie` checks whether the browser accepts cookies; and
  • `wp_lang` remembers the selected website language.

The suffix used for the `wordpress_logged_in_*` and `wordpress_sec_*` cookies is generated by WordPress and may change if the website configuration changes. The configured persistent login-session lifetime is 20,160 minutes, equivalent to 14 days. This is a fixed period: website visits or account activity do not renew or extend it. After it expires, the user must log in again. Session-only authentication and test cookies expire when the relevant browser session ends. The language preference remains until its configured expiry or until it is deleted by the user. Authentication cookies are restricted to the mycvplanner.com website and are not used for advertising.

The login and security cookies are necessary for the requested account and licence-management functions. The language and cookie-test cookies support website preferences and technical compatibility.

4. Google Analytics 4

With any consent required by applicable law, the website uses Google Analytics

4 to measure visits and interactions. Google Analytics may use a pseudonymous

client identifier, device and browser data, approximate location derived from the IP address, and website-interaction data.

Configuration:

  • user-level data-retention setting: 14 months;
  • Google Signals: enabled;
  • Google advertising features: disabled;
  • Google data sharing: disabled; and
  • social-media integrations: none.

Google Analytics commonly uses first-party cookies named `_ga` and `_ga_<measurement-id>`. These cookies distinguish browsers and maintain session state. Their intended maximum lifetime is two years, but browser restrictions, withdrawal of consent or configured settings may shorten their effective lifetime. Google Analytics is not activated for a user before any consent required for it has been given.

5. Consent and Cookie Settings

The website uses a consent banner implemented by Robert Kalb: Code & Counsel. Non-essential analytics cookies are activated only after any required consent. The user may reject analytics cookies without losing the login and licence- management functions.

Cookie choices may be changed through the cookie settings control on the website. The cookie-settings button is located in the website's cookie-consent popup window.

Withdrawal of analytics consent prevents Google Analytics from being loaded for later visits. Previously created analytics cookies may remain until they expire or are deleted through the browser or cookie-settings function, but they are not used by MyCVPlanner after consent is withdrawn. Withdrawal does not affect the necessary login cookies.

6. Other Technologies

The website is built with WordPress and WooCommerce and uses WC Serial Numbers for digital-product and licence administration. PayPal functionality may be loaded when the user proceeds to payment. LoginPress supplies presentation functionality for the WordPress login page. The website contains ordinary outbound links to social-media websites but does not embed social-media feeds or tracking widgets. No advertising cookies are used by MyCVPlanner.

If an additional non-essential analytics, advertising, embedded-media or tracking technology is introduced, it will be disclosed here and made subject to the applicable consent choice before activation.

Refund and Withdrawal Policy

MyCVPlanner Refund and Withdrawal Policy

Version: 1.0 Effective date: 26 July 2026

1. Digital Product

MyCVPlanner is downloadable digital software. After payment, delivery normally begins immediately by providing a download, licence key or activation access.

2. Voluntary Refund Policy

Except where the checkout offers an additional refund right, we do not offer voluntary refunds after the Software has been downloaded, the licence key has been disclosed, or the licence has been activated.

Not liking the Software, no longer needing it, failing to review disclosed system requirements, or expecting a feature that was not included in the product description does not create a voluntary refund right.

3. Mandatory Rights

This policy does not limit rights that cannot legally be excluded.

If the Software is not delivered, is materially defective or is not in conformity under applicable mandatory consumer law, you may be entitled to have the issue corrected or to receive another remedy such as replacement, price reduction, contract termination or refund.

To report a problem, contact support@mycvplanner.com and the seller identified on your receipt. Include your order number, operating system, Software version and a clear description of the issue. Do not send an unredacted CV or other unnecessary personal data.

4. Withdrawal for Swiss Online Purchases

MyCVPlanner is offered for purchase only to customers in Switzerland. Swiss law does not provide a general statutory withdrawal right for ordinary online purchases. Unless an additional cancellation right is expressly offered at checkout, the customer cannot cancel merely because they change their mind after the Software has been downloaded, the licence key has been disclosed or the licence has been activated.

This does not affect rights or remedies that cannot legally be excluded, including remedies for failure to deliver or material defects.

5. Updates, Support and Project Discontinuation

The purchase is for the Licensed Version described at checkout. It does not include a promise of feature updates, future compatibility, continued support, continued downloads, continued online services, continuation of the MyCVPlanner project, or continuation of the Licensor's business.

The later discontinuation of development, optional support or non-promised updates does not itself create a voluntary refund right. This does not remove a mandatory remedy where discontinuation results in a legally relevant failure to supply or lack of conformity.

For planned permanent discontinuation, the Licensor intends on a best-effort basis to keep licence validation and activation available for up to six months after notice, as described in the EULA and Terms of Sale. This is not a guarantee. The inability to use or activate the Software after that period does not by itself create a voluntary refund right, without limiting any mandatory remedy.

6. Changes to Terms and Refusal

Material changes to the EULA or terms governing continued use will be notified to the latest email address provided for the licence, normally at least 30 days before they take effect. Continued use after the effective date requires affirmative acceptance. If you decline or do not accept the revised terms, your licence and right to use the Software terminate on that date and continued use will be technically blocked.

Refusal of revised terms does not by itself create a voluntary refund right. This does not limit any non-waivable right to continue using an earlier version, terminate without charge, receive a refund or obtain another remedy.

7. Refund Administration

Robert Kalb, trading as Robert Kalb: Code & Counsel, is the direct legal seller. Refund and withdrawal requests must be sent to support@mycvplanner.com with the order number and reason for the request.

Approved refunds are returned using the original payment method unless the seller agrees or applicable law requires otherwise. Processing times depend on the payment provider.

MyCVPlanner End User Licence Agreement (EULA)

Effective date: 25 July 2026

IMPORTANT DRAFT NOTICE Complete every item marked [TO COMPLETE] and delete this notice before publication. This EULA should be presented before purchase and accepted before installation or first use.

1. Agreement and Licensor

This End User Licence Agreement ("EULA") is a legal agreement between the person or entity using MyCVPlanner ("you" or "Licensee") and:

MyCVPlanner is the name of the software product and does not, by itself, identify a separate legal entity.

By installing, activating, copying or using MyCVPlanner, you agree to this EULA. If you do not agree, do not install, activate or use the Software. Purchase and refund matters are also governed by the MyCVPlanner Terms of Sale and, where a Merchant of Record is the seller, that seller's checkout terms.

2. Definitions

"Software" means the MyCVPlanner executable software, bundled templates and materials, and any update supplied by the Licensor.

"Licensed Version" means the version of the Software for which a valid licence was acquired.

"Perpetual Licence" means a licence to use the Licensed Version without a fixed contractual end date, subject to this EULA. It does not mean that the Software, updates, compatibility, activation services, downloads, support, the business, or the MyCVPlanner project will be available for the user's lifetime or for any minimum period.

"Consumer" means an individual acquiring the Software primarily for personal purposes where mandatory consumer law applies.

3. Licence Grant

Subject to full payment and compliance with this EULA, the Licensor grants you a limited, non-exclusive, non-sublicensable and, except where mandatory law provides otherwise, non-transferable Perpetual Licence to:

  • install and use the Licensed Version on one device; and
  • use the Software for your own personal or professional activities, including

    • preparing CVs for yourself or as part of a service you provide to others.

The licence permits use of the Software only through its intended user interface and functions. It does not grant any right to access, change, copy, extract or reuse the Software's code, internal resources, protected templates, design elements or technical components.

The licence is for the Licensed Version only. It does not include source code, future versions, additional devices, cloud services, maintenance, feature updates or support unless expressly stated at checkout.

4. Ownership

The Software is licensed, not sold. The Licensor and its licensors retain all rights, title and interest in the Software, its design, code, templates, documentation, trademarks and other intellectual property. You retain rights in CV content and other material you create or enter.

5. Strict Prohibition on Copying, Modification and Reverse Engineering

Except where this EULA or mandatory law expressly permits it, you must not:

  • copy, reproduce, duplicate or create derivative works from the Software or

    • any part of it;

  • distribute, rent, lease, lend, sublicense, sell or make the Software available

    • to another person;

  • modify, patch, translate, adapt, alter or otherwise change the Software or

    • any part of it;

  • decompile, disassemble, decode, inspect, discover or attempt to discover the

    • source code, underlying ideas, algorithms, file formats or internal operation of the Software;

  • reverse engineer the Software or assist another person in doing so;
  • extract, copy or reuse protected templates, layouts, graphics, resources,

    • databases or other bundled content outside the Software's intended functions;

  • circumvent licence, activation, payment or security mechanisms;
  • remove copyright, trademark or ownership notices;
  • use one licence concurrently on more than one device; or
  • use the Software unlawfully or to infringe another person's rights.

Copies created automatically and temporarily as a technical necessity of installing and normally running the Software on the licensed device are allowed only to that extent. No additional backup, archival or other copy is authorised unless a right to make it cannot legally be waived.

Nothing in this EULA prohibits interoperability work, decompilation, security research, transfer or another activity only to the limited extent that applicable mandatory law expressly permits it and does not allow the parties to exclude or restrict it. Where the law requires prior information or permission to be requested from the rights holder, you must first contact support@mycvplanner.com.

Creating and editing your own CV content through the Software's intended functions is not a prohibited modification of the Software.

6. Licence Activation, Reinstallation and Downloads

The Software may require a licence key, online activation, periodic entitlement validation or device association. You are responsible for keeping your order confirmation, licence key and installer in a secure location.

Download links, reactivation, replacement keys and compatibility with a new or reinstalled device are not guaranteed indefinitely. If activation or download services are discontinued, the Licensor is not obliged to provide source code, an offline activation method, a replacement product, an escrow arrangement or migration assistance, except to the extent required by non-excludable law.

7. Updates and Changes

The Software may check for or install updates. Updates may correct defects, address security or legal requirements, adapt to technical environments, or change or remove functionality.

THE LICENSOR HAS NO CONTRACTUAL OBLIGATION TO DEVELOP OR PROVIDE FEATURE UPDATES, UPGRADES, NEW VERSIONS, COMPATIBILITY UPDATES OR CONTINUED MAINTENANCE.

This does not exclude any security or conformity update that must be supplied under mandatory consumer law. Where mandatory law gives a Consumer rights because of a modification or missing required update, those rights remain unaffected.

If you decline or fail to install an update that is necessary to maintain security or conformity, the Licensor is not responsible for resulting problems to the extent permitted by law and after providing any legally required notice.

8. No Commitment to Continue the Software, Project or Business

You acknowledge and agree that:

  • MyCVPlanner is an independently operated software project;
  • the Licensor does not promise to continue developing, selling, distributing,

    • updating or supporting it for any minimum period;

  • the Software, website, download access, licence activation, online features,

    • documentation and support may be modified, suspended or discontinued;

  • the MyCVPlanner project may be abandoned or transferred; and
  • the Licensor's business may be reorganised, sold or permanently cease

    • operating.

Discontinuation does not by itself terminate a valid Perpetual Licence to an already installed Licensed Version. However, the Licensor does not guarantee that the Software will remain installable, activatable, compatible, secure or usable after discontinuation or after changes to operating systems, hardware, third-party services or technical standards.

You are responsible for retaining installers and licence information and for regularly exporting and independently backing up your CV data. Except where mandatory law requires a remedy, discontinuation does not create an obligation to continue the project, release source code, develop a final update, maintain servers or provide compensation.

9. User Content and Responsibilities

You are responsible for:

  • the accuracy, legality and completeness of CVs and other content;
  • obtaining permission to process another person's data or materials;
  • reviewing documents before submitting them to an employer or other recipient;
  • maintaining backups and testing exported documents; and
  • ensuring that your device and intended operating system satisfy the system

    • requirements disclosed before purchase.

10. Privacy and Diagnostics

Personal data is handled as described in the MyCVPlanner Privacy Policy. Depending on the configuration, the Software may process essential licence, security and update information and optional diagnostic or usage information. Any stated opt-out applies only as described in the current Privacy Policy and Software settings.

11. Third-Party and Open-Source Components

The Software may include third-party or open-source components governed by their own notices and licence terms. Those terms apply to the relevant components and prevail over conflicting terms in this EULA to the extent required by the applicable component licence.

12. Support

Unless expressly included in the offer, no dedicated support, response time, service level, maintenance period or error-resolution commitment is included. Any support provided is voluntary and may be limited, changed or discontinued at any time, subject to mandatory law.

13. Warranty Disclaimer and Mandatory Rights

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE". THE LICENSOR DOES NOT WARRANT THAT IT WILL BE ERROR-FREE, UNINTERRUPTED, SECURE, COMPATIBLE WITH FUTURE SYSTEMS, SUITABLE FOR A PARTICULAR PURPOSE, OR CONTINUOUSLY AVAILABLE.

You must evaluate the Software and its system requirements for your intended use. The Licensor does not warrant the accuracy or effectiveness of templates, suggestions, exports or compatibility with third-party recruitment systems.

Nothing in this EULA excludes a warranty, conformity obligation, remedy or other right that cannot lawfully be excluded or limited. Consumers may have mandatory rights if digital content is not supplied or is not in conformity.

14. Limitation of Liability

Nothing in this EULA excludes or limits liability for intentional misconduct, gross negligence, death or personal injury where such liability cannot be limited, fraudulent concealment, or any other liability that mandatory law does not permit the parties to exclude.

Subject to the preceding paragraph and to the maximum extent permitted by law:

  • the Licensor is not liable for indirect, incidental, special or consequential

    • loss, lost profits, lost opportunities, loss of employment prospects, loss of goodwill, or loss or corruption of data;

  • the Licensor is not liable for loss that could reasonably have been avoided

    • by maintaining backups or following disclosed system requirements; and

  • the Licensor's total aggregate liability arising from the Software or this

    • EULA is limited to the amount paid for the affected licence.

These limitations apply regardless of the legal basis of the claim but do not reduce any minimum remedy required by mandatory consumer law.

15. Termination for Breach

This EULA and licence terminate automatically if you materially breach the licence restrictions and fail to cure a remediable breach within any period required by law or stated in a notice. No cure period is required for deliberate licence circumvention, unlawful distribution or infringement where immediate termination is legally permitted.

Upon termination, you must stop using and delete the Software and all copies. Termination does not affect accrued rights, payment obligations, or provisions that by their nature survive termination.

16. Purchase, Withdrawal and Refunds

Prices, taxes, delivery, withdrawal and refunds are governed by the MyCVPlanner Terms of Sale and, if applicable, the Merchant of Record's checkout terms. A contractual no-refund rule does not override mandatory rights relating to withdrawal, non-supply, lack of conformity or other statutory remedies.

17. Assignment and Transfer

You may not assign or transfer this EULA or licence except with written consent or where mandatory law permits the transfer. The Licensor may transfer the Software, project, intellectual-property rights and related agreements to a successor as part of a sale, reorganisation or transfer of the business, provided mandatory rights are respected.

18. Governing Law and Jurisdiction

This EULA is governed by substantive Swiss law, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods.

Subject to mandatory jurisdiction rules, the courts at the Licensor's domicile in the Canton of Zug, Switzerland, have jurisdiction. Consumers retain any mandatory protection and right to bring proceedings in another competent court provided by the law applicable to them.

19. General

If part of this EULA is invalid or unenforceable, it will be limited or replaced to the minimum extent necessary, and the remaining terms remain effective. Failure to enforce a term is not a waiver. This EULA, the Terms of Sale, the Privacy Policy, the checkout disclosures and any applicable third-party terms form the agreement relevant to the Software.

The English version governs unless mandatory law requires otherwise.
